Buyers assume the person they contact about a property represents them as their buyers agent. Some sellers agents tell the buyers they can be their buyers agent.
The State of Florida assumes ALL real estate buyers know ALL real estate brokers and their associates are Transaction Brokers or Transaction “Associates” who DO NOT represent the buyers. Transaction Brokers and their associates can never give the buyers undivided loyalty, confidentiality or all 9 fiduciary duties required by FL Statutes 457.278. Many large firms do not allow their associates to be buyer agents because buyer agents have liability in the real estate transaction. Transaction Brokers do not have the liability that a buyer broker does because the Transaction Broker never represents only the buyers best interest.
A buyer broker or Single Agent who chooses to represent only the buyer must make written disclosure to the buyer. When the broker will be acting in the buyers best interest they are working as a Single Agent. A buyers agent who is a single agent buyers agent will only represent the buyers side of the purchase transaction.
Single Agency means the broker will represent either the buyers or the sellers, but never both in the same transaction. You can view my Single Agent Notice form on the menu bar of this website. The Fiduciary Duties owed to buyers by Florida Buyer Broker are listed below.

A buyer broker contract or agreement (not used by Florida Buyer Broker) obligates the buyers to pay the broker any balance of commission the buyers broker does not receive from the shared commission offered by the seller agents in the MLS, by the builder or developer to the buyer broker office.
Florida Buyer Broker accepts the compensation offered in the MLS by the sellers agents, builders and developers to buyer brokers as the total compensation in the real estate transaction.
Only a buyer broker who does not also list properties for sale can assure the buyer they will negotiate for the lowest price and best terms for the buyer. The buyer broker must keep the buyers financial status and motivation confidential. Florida Buyer Broker is a Single Agency Buyer Brokerage.

These are the Fiduciary Duties required by Florida Law for a brokerage which provides Single Agency Relationships:
Skill Care and Diligence: A buyers agent is required to perform with a higher standard of care concerning the buyer/client.
Obedience: A buyers agent is obligated to obey promptly and efficiently all lawful instructions on behalf of the buyer/client.
Loyalty: A buyers agent is obligated to act at all times solely in the best interest of the buyer/client, to the exclusion of all other interest including his/her own.
Dealing honestly and fairly.
Full Disclosure: All facts about the property and seller, pertaining to the buyers decision to purchase property, must be disclosed.
Accounting: A buyers agent must account for all entrusted funds.
Confidentiality: A buyers agent must withhold the financial status of the buyer from the seller and his agent, unless directed otherwise by the buyer.
Reasonable Care and Diligence: A buyers agent is required to perform with a higher standard of care concerning the buyer/client.
